Yes, they have filed for bankruptcy protection, but are still operating. From what I understand, if you send the certificates in, Cityspree will refund the money.

I have 8 or so certificates left. So far, have not been turned down, but some merchants have definitely stopped doing so. I'm a little surprised that the merchants are willing to incur the wrath of customers, but it looks like what has happened is that Cityspree made deals with merchants/restaurants for a year, and put up the certificates right away, "frontloading" (presumably to increase cash flow).
