Judge throws out most of Rambus case ebns.com

Federal Judge Robert Payne late today dismissed
all Rambus Inc. patent infringement against Infineon Technologies
AG except for three claims. He also ruled that Infineon was not
guilty of any willful violation even if the Munich-based chip maker
were found guilty on the three remaining claims.

Judge Payne has requested briefs from both Rambus and Infineon
on dismissing the three Rambus synchronous DRAM claims left in
the case. He is expected to rule sometime after Thursday whether
the trial should go forward.

In the meantime, Rambus has rested its case and Infineon will
present witnesses in the next several days on its allegations that
Rambus failed to disclose SDRAM patent applications to the Joint
Electron Device Engineering Council (Jedec). Judge Payne also
ruled that Rambus attorneys, in an earlier brief to the court, had
admitted that Infineon did not violate SDRAM claims in the original
1990 patent on the basic Rambus DRAM.

However, he denied Infineon's motion to dismiss the case on this
basis, asserting that in other court documents Rambus argued just
the opposite. The judge said Infineon will be allowed to tell the jury
about the Rambus brief that admitted Infineon didn't violate SDRAM
patents.
