Well, the judge has run up his flag and like we thought he is running a pirate ship. <G> He has prevented Rambus from introducing their evidence, hamstrung Huber the expert witness, rendered judgements from the bench that no way did Infineon willfully infringe (when the evidence is to the contrary) and promoted the JEDEC charges which make no sense if there is no infringement. <G> He has also taken a position which is contrary to patent law in that inventors are allowed to make more than one set of claims to break out different inventive features in their inventions.

This is just the beginning of a long fight. No doubt the Markman decision will be appealed. If the judge directs a verdict from the bench on the infringement battle then Rambus will have been effectively denied a jury trial on the infringement issue which is yet another cause for appeal. If the judge directs a non infringement verdict and does not direct verdicts on the JEDEC issues ( which make little sense if there is no infringement then the judge will smell as bad as judge jackson did in the MSFT case.
