It is my understanding that this case has two parts, infringement and fraud.
I would be very surprised if RMBS prevail on infringement (the stock price is telling us that, and the RMBS lawyer told the JUDGE as much last Friday), but if it prevails on the fraud part, it is my belief that IFX would be at risk on future new lawsuits, and MU won’t be able to use the fraud defence. It is my speculation that the RMBS counsel have made the calculation that with the IFX testimony given so far they have a great shot with this Jury.
