Carl,

For the above reason, it is pretty clear that the judge ends this trial with a finding that Infineon didn't infringe as a matter of law. He now has both briefs, but I don't know when he will make his ruling. But this could come at any time, and it will likely be presaged by his stating that he intends on doing it before he actually does it. You will very likely find it profitable to clean, test and use your sell button.

Well I went I read and I have to say I came away thinking that you are going to be right on this one. My only problem is that I don't know what's in the entire trial record.

If Huber's statements on cross are as IFX says they are in its Memorandum, and there is no other evidence to support the "Huberism" that A10/AP and A8 pins carry all three types of signals,... then IFX should get its directed verdict, IMHO.

The real problem I have arises from the RMBS position on the Markman ruling and Huber's ever expanding understanding of the term "data" that seems to be the heart of its Memorandum in response to the Motion for Directed Verdict. Their application of the claim construction in the Markman ruling, as best I can understand it, would seem to destroy the validity of their claim to having invented a "novel" and "inventive" bus.
