No one ever said non marginable stocks can not be shorted in a margin account. Even if we are all wrong around in regards to the new rule and shorting stocks it seems that LPS5 never did quite get you to understand the dynamics of the present rules in regards to shorting stocks now.

I still haven't seen any evidence that shorting would be unavailable to pattern daytraders who fall below 25k of account equity

Of course it would be available. For overnights and for up to 4 times a week on day trades.
