kelley, re:Particularly since the patents were ruled to be non-infringed. As such, RMBS simply had no way to harm Infineon by any fraudulent behavior whatsoever.

What kind of legal idiocy is that? Would you agree that I don't have any patents which you are personally infringing?

Ok, but I claim that you, Jim Kelley, have stolen my patent for a five-tire RV because your company, Five-Wheel-Wheelies, sells motorcycles with five tires. Furthermore, I claim that you are a crook, that any one who does business with FIve-Wheel-Wheelies may be sued by myself and that any motorcycle dealers who sell your product must pay royalties to ME. I can easily force you to spend millions of dollars to defend against my lawsuit. In fact, I think I will call up your customers and tell them that if Five-Wheel-Wheelies won't pay me my royalties, I'll come after them. Some of them drop your product.

As you can see, the fact that I have absolutely no claim to your hair-brained five-tire motorcycle idea does NOT mean that I can't harm you. I could drive you out of business by my despicable claim that you stole my invention.
