If Democratic controled election boards make ballots that Democratic voters can't figure out we should just give the election to the Democrats?

Also all of this requires the person making the determination to guess how people would have voted. I don't think you can ever be really certain of that. Some people look at the ballots and say well he voted for Democrats for congress so he would have voted for Gore. But this is not a good way to determine the intent of the voter because people don't always vote a for the same party in different contests.
