My conclusion is that, right now, Rambus has no claim on SDRAM or DDR according to Payne's markman decision. If Rambus wins the motion next week, they still have no rights to SDRAM or DDR unless Payne's markman verdict is overturned. If IFX wins next week, and Rambus loses again, then Rambus has no rights to SDRAM or DDR even if Payne's markman ruling is overturned.

A jury's finding of fact that fraud was committed is going to be hard to overturn on appeal - it's the type of verdict that is rarely overturned. If Payne rules that Rambus's fraud renders those patents unenforceable, then Rambus can't collect royalties even if they get Payne's markman verdict overturned on appeal.
