Jim, 3.5% is very high, what if all the patent holders in memory decided to charge 3.5%. There are so many that memory would have 400% added to the cost, or even more. You have no idea the huge number of patents that cover memory and most have small royalties or are nulled by cross licencing. Imagine a 3.5% royalty on your car wheels, then on each part in the car having a 3.5% rroyalty on the whole car.
No, get that 3.5% and soon there would be a quadrupling of memory prices as new patents came along. I would expect people to abandon DDR if Rambus wins as that royalty exceeds the profit on memory. You have only to look at the last years memory debacle to see what an extra 3.5% on the cost would have done.
No Rambus is doomed by it's enormous greed.
