The question, then, is why justices such as Thomas and Scalia,who purportedly stand for a strict interpretation of the Constitution in its original intent, have not risen in revolt against a legal fiction perpetrated by a past court that dramatically and inappropriately expanded federal police power?

I agree we have too many control freaks in this country. Surprisingly it was a unanimous decision. Why the state should oppose a sick person their choice of comfort is strange. We grant the freedom for a person to kill their unborn child but not to smoke a joint . Strange logic or lack of
