Jub, as a long time holder of video game publisher THQ (THQI) I try to keep an eye on the console wars as closely as I can , and I can tell you that getting the machines out on time is critical to both Microsoft and Nintendo. This round of next gen console battles will be particularly intriguing because now there are three players with deep pockets rather than two.

Having said that, IMHO there's no way that a lawsuit threat from a co. with the stature of AXC is going to stop any releases. To put it in perspective, Mister Softee's $50 million budget for publicizing X-Box is larger than AXC's cap size.

The THQ message board on Raging Bull is a pretty good source of info for video game industry data. On a personal note, I've had a substantial holding in THQ for almost as long as AXC (late '95). If you look at the chart you'll see why I've been able to bear the AXC saga with some level of grace and humor. I've always thought that the business lines of these two companies would converge at some point and it seems as though it is about to happen (if one considers Game Pro Minutes, it already has). It still wouldn't surprise me if on-line gaming ultimately becomes the major catalyst to the growth of the streaming industry. The demographics of video gaming are expanding to ages, both below and far after the traditional teen audience. AOL's alliance with Sony on the Playstation 2 is another indication.

Have no idea if AXC royalties come into play here, but think about getting $0.01 for every on-line game played ten years from now.

Sorry for the long post, but the possibilities are still fascinating.
