You may be right. But if I were the judge, I would certainly be looking at the European cases. Remember Payne is not an experienced patent judge and he declined the use of a special master. Then he basically took the Infineon Markman as his bible. It does not pass the smell test.

I am sure that Rambus will have the European Markman translated into English and make it available to Judge McKelvie as well as the appeals court after all it was a thorough 5 month study by court appointed masters.
