Just logged on to the Pacer site to check on the status of the Howe/GATA complaint. Going about like I expected. All the defendants got extensions of time in which to respond, and all filed motions to dismiss, which are pending. The plaintiff is pro se. Instead of responding to each motion to dismiss individually, he's filed a consolidated response. Bad form - in the etiquette sense, legally it's sufficient, but that's not the way to do it - makes it harder on the law clerks, and you never want to make it harder on the law clerks. If this is such a great lawsuit why isn't anyone shelling out for a lawyer?-g-

(My guess - it's not a real lawsuit, it's just for show, and no lawyer wants to be hit with sanctions. How in the world anyone thinks a district court judge in Massachusetts can tell the US president how to conduct foreign policy and the US congress how to conduct monetary policy is beyond me. Guy apparently never heard of the separation of powers doctrine, nor the political question doctrine. But it's entertaining. He seems to think that these institutions have a fiduciary duty to him. Wha?)
