I think you are right. I was also thinking that MU is not paying Rambus anyway, so there's little harm done to them (other than minor inconvinience for their legal team). The real harm is done to DRAM makers who support Rambus (HIT, SSE, TOS, etc.) By not overturning the patents, those guys are still obligated to pay Rambus. As a result IFX and MU have a cost advantage over the rest. I must admit this has been a clever play on Infineon's part.
