The Senate Republicans are the variable. That is what I am watching most closely as the Senate opens back up. The first fight will be over the reorganization itself. They can close the Senate down by filibustering it. They have 41 votes. But you can't do that to move policy-the Senate is too traditional for it. The compromise will be: We need to get Bush's administration officials confirmed without further Borking, but we recognize that judicial appointments would have been bloody before, and will continue to be now.

Daschle must agree to clear administration appointments, knowing that to draw the line there means that the next Democrat president won't fill any jobs either. He will probably take care of that no-brainer decision, but the looney left will scream and cry about more "Ashcrofts" (whom they should never have opposed in the first place). At that point we will find out if Puff is going to be a leader or a follower.

As for the courts the fight is coming-BUT, as a conservative, I wouldn't be at all bothered to see the judicial system whither away on the vine until the people decide, someday, to vote in 60 Senators and a president who are on the same page. I have a lot of confidence that that future group would NOT be liberals.

(The problem for liberals here is that they know I feel that way...)
