The Rambus attorneys pick apart every IFX trial failure. Failure to establish clear duty to disclose. Failure to establish clear evidence of intent to mislead. Failure to establish reasonable reliance. Failure to establish clear evidence of fraud causing damage.

It's interesting to see the common-sense arguments we've been kicking around here for weeks turned into legalese - how did RMBS mislead IFX or commit fraud if Payne's JMOL was that there was no infringement? How did RMBS commit fraud pertaining to DDR is the "first showing" of the proposed DDR standard was 12+ months after RMBS last attended a JEDEC meeting? How could RMBS disclose patent applications to JEDEC when there were none bearing on SDRAM? The '703 patent was granted, and it was disclosed. What else was RMBS supposed to do?

And the "Summary of Infineon's notice of Rambus' patents" is outstanding.

I see this has been kicked around on the board all day, so most have probably seen it. But if you haven't read it yet, you owe it to yourself to do so asap!
