"As things stand," The courts can't even try the vast majority of violent crimes that are less than murder. The DAs are under constant pressure to plea bargain anything they can get the perp to accept.

"there will never be full satisfaction." I will never be fully satisfied with anything on this Earth but I think we can establish consequenses that resolve the issues of heinous crimes so that society can move on. At this point we can't try violent criminals and we are sneaking people back into communities because we simply can't follow through with full appropriate punishments that fit the crimes because there isn't enough money in the world for the current needs.

"However, there is adequate reason to curtail overtly barbarous practices. There is no need for barbarous practices such as torture. They don't resolve anything they just give society a taste of revenge.

"Still, unless a very good argument against the death penalty is put forth, we can register the difference between more ordinary murder and heinous offenses.......

I'm looking for answers here that deal with the "what then" question for this whole category. Its not going to come from political bargaining during sensational times like this or like when Mathew Sheppard was murdered and all the politicos came out with their candles. Philosophers, such as your self, and others here should be tackling the "What then" question from a logical apolitical point and then we can frame it as a practical solution for society that politicians can support, or not.

Whether we throw the death penalty out or not, we are not using it for the vast majority of type two criminals. We are not dealing with the type twos responsibly at all. If we are not going to line them all up and give them injections, Then What?
