FSI International Announces Favorable Ruling in Patent Lawsuit With CFM Technologies
MINNEAPOLIS, Jun 8, 2001 (BUSINESS WIRE) -- FSI International, Inc. (Nasdaq:FSII), a manufacturer of capital equipment for the microelectronics industry, today announced that the United States District Court for the District of Delaware has ruled in favor of FSI's subsidiary, YieldUP International Corporation (now known as SCD Mountain View), and against CFM Technologies, Inc. (now a part of Mattson Technology, Inc.) (Nasdaq:MTSN) in patent infringement litigation brought by CFM relating to its U.S. Patent Nos. 4,917,123 and 4,778,532.
Previously United States District Court Judge Roderick R. McKelvie had ruled that both of these CFM patents were invalid for lack of enablement. In his recent ruling of June 6, 2001 Judge McKelvie also determined that CFM's inventors engaged in inequitable conduct during the prosecution of the patent application which led to the issuance of these patents. Based upon these rulings, the Court has entered judgment dismissing all of CFM's claims and granting judgment in favor of YieldUP on the affirmative defenses of lack of enablement and inequitable conduct. |
