Subpoenaing Julie Fouquet, the famed Agilent Technologies innovator and amateur violinist was achieved but at considerable embarrassment to her and the children. Avoiding being served at Agilent's Deer Creek facility in Palo Alto, CA, her place of employment, only caused the server to meet her at her spacious home in Portola Valley, California. There, I am told and therefore believe, he was confronted by George Zdasiuk, Ms. Fouquet's irate husband and reason for her being subpoenaed. The story goes that Zdasiuk flew into a loud rage and cursed the server demanding that he leave the property. I do not know how out of control Zdasiuk got, but threats were made and I'm sure it was scary for all who witnessed it. On the next day, the server returned and did his duty despite more threats and vulgar yelling from a crazed Zdasiuk, or at least I'm told.
The good news is Julie Fouquet, the first Agilent employee involved in the SLAPP has been served and is scheduled for deposition on June 28. I wish her well and support her testimony. Thankfully, Zdasiuk harmed no one including himself in these unfortunate incidences.
The bad news is George Zdasiuk, Varian Medical Systems (VAR's) Executive Vice President still faces a $50,000,000 class-action lawsuit for invasive bathroom videotaping and Fouquet is a witness named by Zdasiuk's attorneys, the Orrick, Herrington & Sutcliffe law firm in Menlo Park, CA!
A trial date in the California Superior Court has not been set despite more than two years of remarkably acrimonious litigation. Varian and Zdasiuk have lost in two Federal Courts already. And a Special Motion to Strike as a SLAPP is pending in the Cal Appeals Court, so Mr. Zdasiuk has many problems to say the least. |
