I did not ask him where they are regarding raising captial. After I hung up the phone with him I wished I had, though frankly, I would have been asking questions out of my league.

I forgot to mention that he did say they have "7 or 8" patents related to ANSI DMT implementation. While he did not mention royalties specifically he did indicate that part of "pay me now or pay me later" allows vendors to comply with standard and remain in AMTX's good grace. (at least that is how I understood it)

I forgot to mention that I specifically asked him if AMTX was going to OEM the Overture 8 for NEC. He said they were not. I read several weeks ago (June) in Network World that NEC would be making an ADSL/ATM concentrator. I PRESUME NEC will buy the "core" daughter card and integrate it into this product. (though I did not ask him this)

Finally, I AM SPECULATING HERE. It is my understanding that NEC is the lead vendor in the Telstra tial. Given that Overture 8 has been officially productized and given what I perceive to be a VERY TIGHT NEC/AMTX alliance, I BELIEVE that trial is going very well.

I did not ask about TBIT's patent claims but I saw something on Telechoice about it when the news broke. I recall that it said AMTX's attorney's had researched this stuff and contacted TBIT years ago concerning the issue. TBIT never indicated at that time that AMTX was in violation. AMTX's attorneys concurred.
