Not sure if this is good news or bad news....it sounds like it could open the door to more competition. However, this has to damage Nichia's chances in a suit against Cree. nni.nikkei.co.jp Wednesday, June 13, 2001 Nichia Loses 1st Court Battle Over Blue LED Patent TOKYO (Nikkei)--The Tokyo District Court ruled on Wednesday that a patent related to a blue light-emitting diode held by Nichia Corp. is invalid, accepting the claim of plaintiff Toyoda Gosei Co. (7282). The ruling is the first to strike down one of hundred or so blue-LED patents held by Nichia. The disputed patent relates to the basic structure of a blue LED, which Toyoda Gosei argued is in the public domain because old patents relating to it have expired. In April 1999, Toyoda Gosei demanded the Patent Office revoke the patent, but the request was refused, prompting the firm to sue in June 2000. Toyoda Gosei and Nichia have been suing and countersuing each other over several blue LED patents. Nine lawsuits relating to patent infringements have so far been filed in the Tokyo District Court, with Toyoda Gosei losing two cases last year. (The Nihon Keizai Shimbun Thursday morning edition)
