One of the things that bothers me is the wholly unfounded assumption that our liberties as citizens would be protected on the state level. As it happens, the Constitution forbade the federal government from abridging fundamental liberties, but many states were free to do as they pleased (although some had similar "bills of rights"). Until the post- bellum doctrine of incorporation, which forced the states to follow the Constitution in regards to civil liberties and equity, they were at liberty to curtail freedom of speech and press, establish religion within their territory, hold to inadequate standards of due process within the state system of justice, and so on. The states were much more of a threat to individual liberty in the ante- bellum period, and could be at least as much as the federal government at any period.......
