AGILENT EMPLOYEE SUBPOENA UPDATE!

Apparently, Julie Fouquet, the Agilent Technologies witness named by the Orrick, Herrington & Sutcliffe law firm as a SLAPP witness tried to avoid being served her lawful subpoena. Here is an informative letter from the anti-SLAPP attorney Randall M. Widmann to the Orrick SLAPP attorney Matthew Herman Poppe dated Jun 15, 2001:

"Dear Mr. Poppe:

”As I have not heard back from you regarding the deposition of Julie Fouquet which is scheduled for the afternoon of the same date that Mr. Kevin Felch is being deposed, I am assuming that is the date it will go forward. The information from the process servers indicates that Ms. Fouquet was served with a subpoena notwithstanding Mr. Zdasiuk’s illegal attempts to prevent service. For your information, it is illegal for someone to attempt to prevent service of a subpoena by a process server.

I have asked you now several times about your testifying at trial in this matter. Your last response was wholly equivocal, stating that you had not, at that time, decided whether you would or would not. Please be advised that unless you stipulate, in writing, within seven (7) days of the date of this letter that you will not testify at time of trial I will issue a subpoena for taking of your deposition as you will be appearing as a witness at time of trial and we are allowed to discover the information about which you will be testifying. Additionally, you were a percipient witness regarding various events in this case.
