Value Line Cybersmear Suit Quietly "Discontinued"

On June 8, New York County Clerk's Office filed an order issued by the Honorable Paula J. Omansky, Justice of the Supreme Court of the State of New York for the County of New York in a corporate cybersmear lawsuit filed by Value Line Inc. The enigmatic order provides that a motion pending before the Court has been denied as moot and that the case is "discontinued". Readers will recall that on March 21, 2001, Value Line Inc. commenced the suit through issuance of "Summons with Notice". The plaintiffs reportedly asserted causes of action for libel, defamation and malice. According to a report by Aaron Elstein of WSJ.com, Value Line Treasurer David Henigson confirmed that the company's legal proceedings are intended "to root out those who are anonymously assailing the company and Mrs. Buttner on Internet message boards." With entry of Justice Omansky's order, Value Line becomes only the most recent of many companies that have discontinued such actions before any determination on the merits of the claims.
