However it shakes out, the protracted battle between NextWave Telecom Inc., the FCC and the
rest of the industry will continue.

The three-judge panel for the U.S. Court of Appeals was expected to make a decision Friday on
whether the FCC violated procedure by prematurely canceling NextWave's PCS licenses a month after the company
declared bankruptcy in 1999. No decision was announced as of press time.

However, sources say the issues are likely to stay in contention for some time, regardless of what
the appeals court says. The losing party could ask the U.S. Supreme Court to review the case.
