I don't know about every state, but in Wn and all other ones I do know about, except Nevada, prostitution is illegal so any contract between the parties, even if there were one (and there isn't) would be unenforceable. Also, even if the parents made a contract that if there was a child he wouldn't pay support, the courts wouldn't enforce it. Child support is for the child, not the parent, and the parent can't contract away the child's right. Plus, the ultimate responsibility for suporting children rests with the state and welfare, so the state makes sure that people can't get out of their support obligation (even if the woman can support the child now, can she in five years? Or will it then go on welfare with the Dad nowhere to pay for it?)

So there's no enforceable contract to sue on.

One reason protitutes should get their money up front, because they can't sue for it if the guy doesn't pay! Also a reason why they choose to be backed up by pimps with guns rather than lawyers with lawsuits.
