E-mails are not "in the public domain," as you state. Whether they can be stolen by hackers or not, they remain in law private and confidential.

As for recording telephone calls without the permission of all other parties, that would constitute a felony. Do you understand what that means? Do you intend to commit a felony? I would hope this information will prevent that unhappy state of affairs. If it comes to my attention that either you or your colleagues have with gratuitous malice aforethought misrepresented yourselves to me either through written electronic mail or telephone communications, there shall be grave consequences. If it comes to my attention that you have illegally recorded telephone conversations without my permission I will immediately inform the Federal Bureau of Investigation.
