Ny Times Business section for tomorrow has full report on the FCC/Nextwave fiasco, a fiasco which Nextwave handily survived.

And, believe it it or not, the lawyer successfully arguing Nextwave's case before the Appelate court is now the government's lead lawyer in cases involving the Fed and coming before the Supreme Court.

Will the FCC appeal its losing case to the Supreme Court?
Don't bet on it!

Will Nexwave continue to prevail? Don't ask Verizon or ATT

And Kennard, the Clinton appointed head of the FCC during the former administration, was paid well by the industry for leading their fight against you. Ask Nextell to tell you how much he was paid. Kennard is now on Nextell's "legitimate" payroll. Better to be legitimate than illegitimate I've always heard.
