NextWave, by all appearances, again owns spectrum - valued by auction at 16B - for which it must pay 4.7B.

And I believe, that in light of recent US government statements regarding freeing spectrum, NextWave's spectrum is worth more rather than less - now.

And it's very likely that Nextwave can receive serious financing from Q for an early, aggressive 1xevdo rollout - perhaps coinciding with Q's Australian network. Could there be a better strategic move on Q's part than to bring full-blown, data-centric, all you can eat 1xevdo service to the US in 02?

Simply stopping there ---- I bet NextWave began receiving (perhaps even unsolicited) offers of credit yesterday afternoon. What better collateral could a banker dream of than the last open spectrum that may be available in the US for years --- that nearly every established carrier covets --- for $0.25 on the dollar?

Even though NextWave is still in bankruptcy, I can't think of another carrier that is in as good or better financial position. With established carriers nearly crushed with debt burden - with their stock prices in the toilet - some with imminent capacity emergencies and convoluted technology paths to 3G - weighed down with legacy networks and systems....

If Unicom can build a huge, greenfield cdma network for a billion and change - so can NextWave. If Unicom can build a huge cdma network in 5 or 6 months - so can NextWave.

Even if the FCC drags this out for a year - they still have plenty of time to kick ass.

Another interesting wrinkle is that a rejuvenated NextWave would be the perfect partner for Branson's Virgin Mobile... who could guarantee a serious capacity purchase contract beginning the day the network was lit.

I think, as of 2:00 Friday afternoon, creditors were no longer an issue. They can be paid - in cash...

"You settle before the case, not after you win it," he said.

Yep.

This is a remarkable turn of events.
