That has been my personal opinion for some time.

I also think that the consumer (wireless user, or potential wireless user ) is an aggrieved party.

I agree with that, and would add they failed to guard against a licensee seeking protection of bankruptcy.

I'll add one thing. I personally believe that if the C-Block licensee in question were DCR who had chosen to build out GSM, and whose equipment vendor financing was based on that choice, had, after declaring Chapter 11, decided NOT to return their licenses (wjhich are now being built out) and instead battled it out in the courts like NextWave is now doing, that thread sentiment might be substantially different on this matter.

It is possible that this matter may be settled without more court intervention.

It might be wise however for this case in fact to be heard by the Supreme Court.

Spectrum auctions will take place in the future, and it may be wise to settle issues related to any conflict between bankruptcy law and the FCC’s regulatory authority, and related legal uncertainties about spectrum.

All JMHO ... as of the current moment.
