One of the best aspects of the district court's decision to return NW's licenses to them was the fact that the decision was unanimous. (3-0) This indicates the lack of a political element in their decision. This unanimity at the district court level mitigates against the Supreme Court reviewing the case.
Secondly, I don' think Michael Powell feels compelled to cover William Kennard's rear. Kennard's actions re: Nextel are looking pretty suspicious about now. This court loss doesn't have to be an FCC defeat but a William Kennard defeat. Remember, this is not Bill Clinton's FCC.
