Andrew, I do not think we disagree over the court ruling or the FCC mishandling of the whole affair. As you note, the successful bidders of the reauctioned spectrum now have a claim on the FCC (i.e., us taxpayers), which nullifies any benefits that might have accrued to the public from the proper auction of spectrum. Having promised the same "property" or asset to more than one buyer places the FCC in a position not unlike Great Britain, which agreed to the establishment of a homeland for the Jews, after it had given the same land to the Hashemite Kingdom of Jordan in return for assistance against the Ottoman Empire. That struggle still continues. This one could take a long time to solve as well.
