Does that mean if we would have humanely destroyed the million or so people with AIDS ten years ago we would have been morally right. Considering the fact 25,000,000 have now died, would putting down 1,000,000 been acceptable in your morality? (Which changes of course based on the expediency of the flitting moment - so I guess in your system hindsight is always 20-20 - but taking action is always wrong.)

"Legality is concerned with what is acceptable to society." Not as long as we have laws that are open to interpretation by judges. If you and Greg McRitchie both steal a toaster you will most likely get different punishments depending on the judge you pull and the lawyer hired to stroke the judge.

"Equally important, social acceptability changes, and the capacity for change is a necessary element in any functional code of conduct." It would be lovely if that were true, unfortunately most people can't memorize the 10,000 pages of small print in the legal code to conduct themselves in accordance with your wishes, therefore eventually governance is impossible.
