NASD Bars Former Broker For Posts on Message Board June 26, 2001 By Riva Richmond Dow Jones Newswires NEW YORK -- NASD Regulation Inc., the Washington regulatory arm of the National Association of Securities Dealers, has for the first time barred a broker from association with any NASD member firm due to postings made on an Internet message board. NASD levied one of its harshest punishments on Don J. Akin of Scottsdale, Ariz., former broker at Vanguard Marketing Corp., which fired him in May 2000 for posting the messages. Mr. Akin also lost his Series 6 and 63 licenses.
According to official NASD documents, Mr. Akin posted between May 25, 1999, and March 6, 2000, eight false statements and seven baseless price predictions on a message board dedicated to LCA-Vision Inc., a Cincinnati laser vision correction services company, in which Mr. Akin personally owned stock.
NASD says Mr. Akin's messages violated conduct rules 2110 and 2210, which require a "high standard" of conduct and truthful communication of information. Mr. Akin settled with NASD without admitting to or denying the allegations. |
