Agilent employee JULIE FOUQUET to be rescheduled for deposition:

June 29, 2001 letter from the famed anti-SLAPP attorney Randall M. Widmann to the insipid Matthew H. Poppe of Orrick, Herrington & Sutcliffe

"Dear Mr. Poppe:

I am in receipt of you letter with proposed dates for the taking of Mr. Zdasiuk's deposition. I have conferred with Mr. Falcon. We are available on July 25 at 9:30 a.m. at Mr. Falcon's office for the taking of that deposition.

Please provide me with available dates for the taking of the depositions of Mr. Kevin Felch and Ms. Fouquet. Unfortunately, I had to cancel the depositions due to the fact that a family emergency occurred. My parent's house burned down. Obviously, I was needed there to assist them.

Finally, I have noted that you are unwilling to engage in ADR. I find that puzzling since you have taken a position that all of the Orders of the Federal Court are in effect and there is an Order of the Federal Court stating that we must engage in ADR. In any event, it is unfortunate.

Sincerely,
LAW OFFICES OF RANDALL M. WIDMANN"

Agilent seems to have rebounded a bit and is now above $30!
