I find myself considering the nature of the differences and similarities between the conduct of MSFT and that of RMBS. They have a good deal in common. One of those things is INTC. Another is the Justice Department. Perhaps the most common of the commonalities are the hundreds of competitors complaining about their practices.

But what really keeps bringing me back to such issues is the simple fact that after 100 years of "experience" the Federales have proven themselves entirely incompetent at both establishing and enforcing a workable standard for regulating anti trust problems.

Now before you folks get all hot and bothered about how "Off Topic" these musings "appear" to be; let me direct your attention to the arguments concerning the post trial Motion to Dismiss "Monopoly Count" of the IFX Counterclaim. Actually I can't "direct" you to it because Rambusite apparently doesn't have the cash to publish it and RMBS doesn't want to.

But Rambusite has in fact published the RMBS response to the Mystery Monopoly Motion.<vbg>

If you go there you will find that RMBS asserts, among other bits, that:
"Infineon alleged in Counts 12 and 13 that Rambus engaged in exclusionary or predatory conduct by (1) defrauding the Patent and Trademark Office (the Walker Process claim) and (2) failing to disclose its patent applications to JEDEC." [see, page two at above URL]

IFX wants the dismissal of Count 12 without prejudice and RMBS wants it dismissed with prejudice.

We don't have the IFX reply to the above response by RMBS, but we do know the judge decided the matter in favor of IFX: see Docket entry #358

Regardless of the outcome in the IFX case, the MU trial figures to be a full court press on anti trust issues. There may be much more evidence than Mr. Bilow has provided regarding this. If MU has it, a much "tastier" trial on the fraudulent and inequitable conduct of RMBS both at JEDEC and at the PTO may be in the offing for our winter reading pleasure.

In any case before this is all over the Justice Department may be "shamed" into taking some action.
