<font color=blue>I posted this information, all of it publicly available earlier here and elsewhere, so that all of you could see where this is headed.
Now, when a group of posters launch waves of what I consider to be highly negative, reckless and discouraging commentary then I am strongly inclined to believe that there is an ulterior motive operating here. However, on the chance that where some of you are concerned, this is not the case, I extend to you the benefit of the doubt and say as I always have, something I said to lawyers from the beginning: there is no need for lifelong friendships to be established in this process, though I believe the most productive footing on which to go forward is an amicable one. I more than most completely understand and accept that, in a field absolutely raging with lies and betrayal, where so much is not what it once seemed, where emotions can run very high, it is very hard to believe anyone. The Internet breeds this. There is so little personal contact.
Therefore, I would again say to all honest potential plaintiffs in this case: I requested that you contact me, but this is certainly not a requirement for your inclusion as we go forward. If you have been hurt by these criminal predators then you bet I want to help you, and not because I have any ulterior motive - except that I do hope our group is a strong one. This is very important. A suit such as this one will exact a certain amount of fortitude. The brokers and sites will seek to discredit you and our case. That can become unpleasant, but it is the risk you take opposing them. The alternative, capitulating to scoundrels, is, however, unthinkable to me - and, I hope, to many of you as well.
Now I did not dismiss the question of privilege out of hand. Legal advice and procedures are very important for the protection of the rights of all involved. A coming together of plaintiffs through discussion here and elsewhere does not set anyone up for lawsuits, as has been speculated here. It does not forfeit your legal protections, unless you begin to provide specific information, the kind of which I never requested. Identity theft is a problem, though. None of you have ever met me, yet. I hope if you join me as plaintiffs that you will. To me, that is important. I would wish to meet all co-plaintiffs, together, as the law firm certainly will need to meet all of you in person before you can retain them and formalize your relationship of attorney/client.
So, what I intend to do now is forward the information of those of you who have contacted me to Counsel. Those of you who have opted to await further developments, that is of course perfectly fine, too. I will be discussing the matter with Counsel shortly. We shall see if perhaps a pending public statement by me informing you about this firm would be appropriate. However, that decision I cannot make on my own initiative. Please bear with me a short time and I will do my best to inform those of you who wish this information.
One thing has been stated here by a poster whom I do not trust in the slightest, but the point is nevrtheless a very good one, and leads to another: no, I do not hold all evidence available in this case, but I can tell you that I have enough to win this case outright. However, I have considered the following. You know, these brokers and sites churning traders have pitted traders against one another. In large part, they are responsible for this atnmosphere of distrust. I remember times way back when traders were far more united in spirit - even if on opposite sides of a particular trade. It is very sad how that has been lost. What I had hoped would unite the honest among you was the fact that the brokers and sites stole honest trading from this field. I wonder if any of you have considered that market makers do not mind this either. The democratic influence on the markets traders had gained was a direct threat to certain interests on Wall Street. Divide and conquer was the objective also, and it has succeeded. Look at SI. The difference between now and the early days could not be any more striking. These are all collateral consequences of what the brokers and sites have done. Therefore, no one has to become close friends here, but it would be vastly more productive for all traders if some of the bitterness and mistrust were taken out of this discussion, and the communal spirit of old were returned. We see that here sometime soon, and I know we are on our way to winning.
I wrote this post tonight because many of you contacted me about this. We shall see if it is possible. I had hoped from the ouitset that it would be but great mistrust reared its ugly head right from the very start. I publicly give all honest traders here my word that I am doing my best to change what has happened, and if you have been among those who have been hurt, I am on your side. There is no requirement that you join this case now - you can launch others - but I will say, in answer to another comment, that the reason it has taken so long to organize is that one thing that is critical is the law firm involved. I spoke and met with many others before coming to believe in this one. One law firm actually went right behind my back and informed defendants of a pending suit! My goodness. So it has taken a long time. In a short while I hope many in trading will join me as we go forward to right this scandal. I will be talking with you again soon.
