It wasn't as if the government of FL was united in the determination of the winner and the USSC overturned it. Katherine Harris certified the election results. She was (still is?) the secretary of state in FL. She acted under Florida law, Sec. 102.111(1), "all county returns shall be certified by 5 p.m. on the seventh day after an election, which is 5 p.m. on Nov. 14th, in order to be included in the certification of statewide results." While I'm not so sure I liked the way the USSC reached its decision, it doesn't really seem like a states rights case to me, so this at least is not a "blaring inconsistency" in Bush's behavior.
