All right, here is my reader's digest view of the decision, never before seen on this thread. What most people cared about in the decision was whether the Court would allow a recount to proceed or not. On that score, the vote was 5-4. Of the four dissenters, two saw nothing wrong with the recount, and would have let it continue, and two had Equal Protection problems with the standards governing the recount, but would have allowed Florida Supreme Court to cure this problem, at which point the recount could have proceeded. Had O'Connor agreed with either of these two views, the recount could have gone forward, after the Florida Supreme Court had articulated an appropriate standard. Because she voted with the other four, the recount was stopped and the matter was ended. So now the dust has been plowed into its atomic elements, and now I really am done discussing it.
