Appeals Court Rules for AT&T ISP Access

WASHINGTON (Reuters) - A U.S. appeals court on Wednesday upheld a lower court ruling that Henrico County in Virginia could not force cable company MediaOne Group, now owned by AT&T Corp. (NYSE:T - news), to open its lines to rival Internet service providers.

Henrico County attempted to condition the transfer of MediaOne's cable franchise by requiring that the company provide open access to its telecommunications facilities, specifically its cable modem service.

``Because the open access provision is inconsistent with the Federal Communications Act, it is preempted. We therefore affirm the judgement of the district court,'' the U.S. Court of Appeals for the Fourth District said in its ruling.
