I'm inclined to believe that juries would rather err on the side of potential innocence. I once sat on a six person jury in a drunk driving case. When the lawyers were finished, I was feeling sorry for the defense attorney.

But the jury was 4 guilty, 2 innocent. I spent all day trying to convince the two that the drunk was actually guilty, and wound up convincing only one and wasting the tax payers' money with a hung jury.

The drunk caused an accident by trying to drive underneath a logging truck. He admitted to having downed 13 beers before 10 am, and the accident happened at 11 am. Go figure.
