You may not like it, but that is current US law.
Why should I not like it? All that is needed now is to tie the two militia classes together with their rights and responsibilities. The national guard gets the APCs and occasional tank, the unorganized militia gets to keep small arms once they have identified themselves and their weapons and shown some proficiency. That's exactly the kind of sensible responsibility I would hope for.
