It is not complex, those rights always existed but were either not enforced (the government failed in its responsibility to protect individual rights -- its cardinal reason for existence), or failed to negate unlawful laws that sought to deny any individual American of their basic rights.

None of what you mention are new rights, but simply the enforcement of exist rights which were immorally and illegally denied under the auspices of a "law."

No rights have been "gained." They have only been selectively enforced (or left unenforced).

As for the men and women who are currently incarcerated in American prisons: each one of them who has been convicted and sentenced solely under the "drug laws" now illegally being enforced are, IMO, political prisoners.
