They can disagree, but they would be erroneous. An adult, American woman has full natural and constitutional rights. A fetus (potential human) has no constitutional rights, unless PETA wins and you want to extend "animal" rights to it.

A fetus would not have animal rights it would have human rights as it is an undeveloped human. The constitution itself does not mention the unborn (nor does it mention the privacy right of a woman to have an abortion). A fetus is more then a potential human it is a human just one at an early stage of development.

I disagree most strongly with your postulation of "rights" created by courts.

Could you provide more detail about your disagreement. I normally use the term rights merely to mean natural rights. By that definition courts or legislatures or constitutions or laws do not create rights. I did I believe mention the idea of customary rights but I said I wouldn't use the term normally and I wasn't specifically talking about courts.
