The crap came after he left office.

The crap may only have begun to stink after he left office, but his Administration laid it out there in the first place. The Clinton Administration enthusiastically picked up and ran with it. After two administrations have followed the same course, particularly when they are of two different parties, a precedent was established. That's not to say that the next guy, in this case, GWB, can't change direction but he can't "disappear" the precedent. It's a divorce, not an annulment.
