Constitutionally I would say state governments are entitled to do this but I don't know about the federal government.

Personally I feel the idea system would be one where education was privately provided. I think socialism doesn't work much better in education then it does elsewhere. Even where it is decided to have the government subsidize something its usually better to provide a subsidy and then let the consumer of the good or service buy it from private sources then it is to set up a government run system to distribute goods or services. I would say this holds true for education as well.
