I would think that one could make a case that some adultery is not adultery, although probably not the adultery you're talking about, which is likely just excuse-making.

Given the negative connotations, I wouldn't use the word, adultery, in situations where the marriage is over, the parties are living apart, but the divorce is not yet final. I would also not use it in situations where the parties have an "arrangement" that authorizes extra-marital sex. Or when the spouse has been in a persistent vegetative state for years. But then, one might call that excuse-making, too.
