I am not clear on why a company can put out PR and advertise and hire people to deal with shareholders if all they need to do is execute a business plan?

Realistically, lawsuits often are part of the business plan. You sue people who don't pay you or deliver what they promised on time. You sue for libel or slander if another company says their product has ten times the ingredient yours does and it only has 8 times as much.

I grant you that it often is not worth it but a good threat to sue often gets results without needing to actually sue.

FWIW, I looked to see what Jacobs says recently about AREM:

I see a more conciliatory guy wondering what to salvage out of this.

The other Jacobs who works for The Motley Fool may be considering his options after yelling FIRE in a crowded theater and suggesting REFR was a perfect short. He backed off to say he just wanted to start a DISCUSSION and was presenting one side but did not really mean it. Today, one of his brighter colleagues filed an article suggesting REFR fits none of the criteria (except for having a price over $7) for shorting a stock as set by the Fools. Of course, he would not suggest they buy it either. That leaves open the question of what any Fools should do who went ahead and shorted the stock but now are being advised against buying any to cover.

I suggest one reason for this change in mood is that Jacobs and TMF have been made aware of what could happen if anyone chose to sue them over their idiotic initial press release that was completely unbalanced and against their own standards. So, perhaps they do not need to be sued.

So it goes.
