I take it you do not agree that the Equal Protection Clause arguments were bogus, or inconsistent with the majority's previous rulings? I'd like to see you (or anyone) make the argument -- it's a tough row to hoe.

As for averting a crisis, for sure, it would have been messy if the election had gone to the House. But messy does not neccesarily equal a "crisis" -- the Constitution has provisions dealing with a contested Presidential election.

More importantly, the election would have been decided by politically accountable members of Congress, not nine unaccountable judges who are not supposed to be deciding political questions.
